PROVIDENCE — A legal loophole that allowed an alleged peeping Tom to avoid prosecution recently in Middletown would be closed under legislation announced yesterday.Lawmakers drafted the bill after learning about the dismissal of a disorderly conduct charge last week against a fitness club owner accused of peeking through a ceiling tile at a woman taking a shower. Prosecutors said they had to drop the case because the laws states that a defendant must enter the property of another and, in this case, the defendant owned the club.

In September, a 43-year-old instructor at Bridge to Fitness told the police that while taking a shower, she saw the fingers of a man’s hand grabbing a ceiling tile above her, according to court records. She screamed, grabbed a towel, put on some clothing and ran out to complain to co-owner Michael Cecchi.
When the police arrived, they found a ladder placed against the wall next to the women’s shower area. Their investigation led to the arrest of Cecchi, 37, of 29 J.H. Dwyer Ave., Middletown. But last week, prosecutors dropped the disorderly conduct charge against him because of the loophole.

“When this legislation is enacted into law, all peeping Toms, whether they commit the crime on their own property or the property of another, will be prosecuted,” Rice said.
Closed door equals no looky loos. they have already established a ruling in a case where somebody was taped having sex a club washroom. It was ruled a reasonable expectation of privacy. maybe he should have put that in contract or something saying he maintains the right to intrude on you on his property anywhere you are...
